This document describes the terms and conditions of sale that govern the contracts for the purchase of products and the management of orders placed on the website www.playxexxo.com.
Formation of the contract and delivery of the goods
Any order placed online on the website www.playxexxo.com implies the conclusion of a sales contract with “Scalmy Shop by Guido Scalmato”, hereinafter “Scalmy Shop”.
By confirming the electronic order, you declare that you are aware of all the information provided during the purchase process and fully accept the general and payment conditions described below.
Scalmy Shop reserves the right to accept or reject the order, even partial. However, acceptance is considered tacit after 10 days if no communication is received.
By clicking on "Buy now" you place a binding order for all the products in the cart at that time and an email will be sent to you with the details of the order and all the data you have provided: we ask you to check the order within a reasonable time. correctness and inform us of any corrections to be made on non-compliant data.
The products will be shipped to you as soon as they are available and, in any case, not before the full purchase amount, including shipping costs, has been received by us.
We would like to point out that in those exceptional cases in which our suppliers cannot deliver the goods to us, both for availability and for delivery times, we are not obliged to deliver all or part of the products ordered. We are not legally responsible for the unavailability of products and will promptly inform you of the situation.
If all the products are not available, you will be refunded the full amount paid, including shipping costs, without undue delay.
If only part of the products is not available, you will be reimbursed as soon as possible for the amount of the products not received and the portion of the shipping costs not used for sending the available products.
Where the period of time is expressed in days worked, they must be understood as working days every day between Monday and Friday, excluding holidays.
Product prices and shipping costs
We will apply the prices specified in the offer at the time the order is placed. The declared prices are gross of taxes (including VAT) and the VAT applied is the German one according to the statutory rate. All amounts and payments must be understood in the Euro currency.
Shipping costs are to be paid for each product in the order, the total of which will be specified on the order page. Shipping costs depend on the type of service and courier chosen and the country of destination.
Payment
For payments we accept the following methods: bank transfer, credit card, debit card and PayPal.
Payments are all made with a secure connection (https), visible on the browser in the address bar.
The transactions carried out are all carried out with an SSL encrypted connection (128 bit)
In the case of purchases by credit card, the costs will be charged to your card when we ship your order.
You are responsible for any costs associated with economic transactions including due to currency conversions.
You give your consent to receive invoices and credits exclusively in electronic format.
Legal right of revocation
When making a purchase on Scalmy Shop, you have the right to be able to revoke it within 14 days from the time of receipt, confirmed by the courier's delivery note.
A motivation is not required for the revocation, but a clear communication must be sent via email to supporto@playxexxo.com: we will communicate the shipping methods.
You will be deemed to have complied with the revocation period if you send the communication before this period expires.
If you revoke this contract, we are obliged to refund the cost you paid for each product you intend to return including shipping costs, calculated as the difference between the cheapest cost available on our site for your destination and the method you have chosen.
The products must be returned correctly packaged in their original packaging, not damaged and inserted with one at your expense.
If the product is damaged or does not comply with the above, the withdrawal will not be effective.
The shipment by you must take place without delay and at least within 10 days of your notice of revocation.
The refund, unless otherwise agreed, will be made using your original electronic payment method at no additional charge for the transaction.
The refund will be processed within 5 working days from the moment of receipt of the goods and verification of the integrity of the goods.
In this regard it is suggested to record a video or take photos that can prove the integrity of the goods inside the package before shipment, as it is required to cover any loss in the value of the goods, if such loss in value is attributable to its incorrect management of the goods themselves, in examining their conditions, properties and functioning.
Legal liability for defects in the goods and further information
The applicable laws regulate our liability for defects in the goods.
In the event of receipt of goods with defects, you are entitled to a refund as described above but not to damages.
Upon receipt of the goods, you are required to check that the packaging is intact, not damaged or wet or altered in the closing mode: in this case you must immediately challenge the courier making the delivery and accepting with "reserve" the parcel also making the same note on the accompanying document that must countersign to the courier.
Order fulfilment and delivery times
The shipment of orders with products in stock takes place within a maximum of 5 working days.
All the products offered are in stock but it could happen that at the time of the order the stock is not yet updated and therefore find yourself without the requested product: we will inform you of the lack of the product and define with you the total cancellation of the order, or the cancellation of the missing product from the order, or the wait until availability.
